Dear [Legislator]:
I am writing you today to ask you to support Rep. Hudgins in dropping 4 bills that will amend the Deed of Trust Act to ensure that the Act will protect the integrity of our land recording system. In addition, these amendments will ensure that entities looking to foreclose and/or reconvey actually must have standing to conduct these actions. These four bills are: HB 2656, HB 2657, HB 2658 & HB 2659. Rep. Hudgins needs your support to re-issue these bills this session. I am asking for you to provide your support for these needed changes.
Our system of property ownership in our state, which has served us well for many years, has been recently diluted to accommodate reckless and unlawful business practices of the parties that are/were involved with the securitization of residential mortgages. In addition, parts of the Deed of Trust act that were implemented long before private label securitization of mortgages came into the market, are not addressing serious issues relating to land title integrity and homeowner protections.
Unfortunately, the “stakeholder” group with the most dominant presence in Olympia (Mortgage Bankers Association), has worked very hard and very smartly to influence the other stakeholders not to present and support important legislation that could restore land title integrity or at least help homeowners defend their own title.
This email is meant to ask for your support to these important amendments to the Deed of Trust Act that Rep. Hudgins is proposing, including the four bills he dropped last session which are:
HB 2656, HB 2657, HB 2658 & HB 2659. This email is also to provide awareness that there are very serious issues with the core structure of the system that provides a very large portion of the state’s revenue each year: property tax revenue. If we don’t address and protect this system in our state, we will be very vulnerable to potentially devastating effects from the next looming housing crisis.
